Mediation is a voluntary, confidential process where a neutral third party, known as a mediator, helps individuals or groups in conflict come to a mutually agreeable solution. The mediator facilitates open communication and helps clarify each party's needs and interests to resolve disputes peacefully and collaboratively. Unlike court proceedings, mediation focuses on finding practical, win-win solutions that all parties can agree to, rather than assigning blame or enforcing legal judgments.
Mediation is a private, informal process, while court is a formal, public proceeding. In mediation, the parties involved maintain control over the outcome and work together to create solutions. In court, the final decision is made by a judge, often with less flexibility. Mediation is typically faster, less expensive, and less adversarial than litigation, making it ideal for couples and families who want to preserve relationships and find customized solutions that suit their unique circumstances.
Mediation is open to anyone experiencing a conflict who wishes to resolve it through a cooperative process. It’s especially beneficial for couples to work out their differences prior to a legal marriage. Mediation can also be used in family disputes, custody agreements, co-parenting challenges, and other conflicts. Both parties involved in the conflict, along with their attorneys (if they choose), can participate. The mediator facilitates the discussion but does not make decisions for the parties.
